Overview

Dan Wilson counsels clients facing international trade remedy proceedings and related enforcement matters. He has served as a first chair litigator in complex administrative proceedings before the U.S. Department of Commerce and the U.S. International Trade Commission, and in appeals before the U.S. Court of International Trade and the U.S. Court of Appeals for the Federal Circuit. He also has significant experience in guiding clients through high-stakes trade remedy enforcement actions before U.S. Customs and Border Protection.

Trade Remedies

With a gift for working across cultures, Dan has represented foreign and domestic clients in a variety of complex international trade disputes, including antidumping and countervailing duty proceedings and global “safeguard” investigations. He has successfully represented foreign exporters and manufacturers in achieving significant reductions — or even outright elimination — of duty liability in the clean energy, home appliance, consumer products and heavy industry sectors. Dan has also successfully represented parties in court appeals of trade agency decisions before the U.S. Court of International Trade and the U.S. Court of Appeals for the Federal Circuit.

Trade Remedy Enforcement Proceedings

Dan represents clients in high-stakes trade remedy enforcement proceedings before U.S. Customs and Border Protection. He has successfully defended clients against allegations of duty evasion under the Enforce and Protect Act, and assisted clients in mitigating or eliminating penalty liability for nonpayment or underpayment of Section 301 and Section 232 duties through prior disclosures and other mitigation strategies. Clients value Dan’s ability to quickly diagnose the scope of the issues at play in an enforcement proceeding and find effective resolutions through proactive engagement with U.S. Customs enforcement personnel. 

Trade Compliance and Stakeholder Engagement

Dan has been at the forefront of helping a broad range of clients mitigate risk and leverage opportunities associated with the federal government’s increasing use of other statutory regimes, including Section 232 national security investigations, Section 301 unfair trade investigations, and tariff actions brought under the International Emergency Economic Powers Act. Dan has significant experience assisting companies in competitive landscape analysis and restructuring supply chains to mitigate tariff exposure. He also frequently advises on the tariff and trade implications for mergers and acquisitions. Dan also assists clients in engaging with stakeholders within the executive and legislative branches on trade policy matters.

Representative Experience

  • Obtained negative injury determination at the U.S. International Trade Commission on behalf of rigid packaging distributor in antidumping and countervailing duty investigations on imports of Glass Wine Bottles from Chile, China and Mexico.
  • Successfully argued for revocation of the countervailing duty order on Utility Scale Wind Towers from Indonesia before the U.S. Court of International Trade and the U.S. Court of Appeals for the Federal Circuit.
  • Secured consistently low or de minimis antidumping duty rates for a leading heavy industries manufacturer in complex antidumping proceedings before the U.S. Department of Commerce on imports of large power transformers from Korea.
  • Obtained favorable settlement for a multinational importer and manufacturer of automotive parts in successful litigation before the U.S. Court of International Trade contesting antidumping duties assessed by U.S. Customs and Border Protection.
  • Assisted in obtaining favorable antidumping duty rates for producers involved in several antidumping investigations and administrative reviews and subsequent litigation related to various steel products from Korea.

Personal Interests

Most of Dan’s free time is devoted to his young son. He’s also an avid cyclist and runner, an antiques enthusiast, and a committed science fiction fan.

Dan places a high priority on providing pro bono legal services for vulnerable and underserved populations. Representative matters include: 

  • Served as counsel for over 100 senior citizens in tort litigation arising out of a fire that destroyed their public housing complex in Southeast Washington, D.C. 
  • Obtained grant of clemency on behalf of a federal inmate sentenced under harsh sentencing guidelines. 
  • Advocated on behalf of District of Columbia residents incarcerated in the federal Bureau of Prisons in proceedings before the U.S. Parole Commission.
  • Represented victims of human trafficking and domestic abuse before U.S. Citizenship and Immigration Services in immigration proceedings.
