The DOL’s Focus on Conflicts of Interest (Part 2)

Benefits and executive compensation partners Fred Reish and Joshua Waldbeser and counsel Joan Neri co-authored an article titled “The DOL’s Focus on Conflicts of Interest” for the Journal of Pension Benefits.

The authors provided an overview of conflicts of interests that are prohibited transactions under the Employee Retirement Income Security Act and the Internal Revenue Code of 1986. They focused on “self-dealing” transactions, which occur when broker-dealers, registered investment advisers, and their representatives accept revenue sharing payments from custodians in exchange for investing in certain types of funds.
