The receiver of an insolvent construction finance company obtained a $42 million settlement related to claims of fraudulent transfer and breach of fiduciary duty. Our firm represented the receiver, which was appointed by the district court to secure and dispose of the construction finance company’s assets, establish and administer a process by which the company’s creditors could file claims against it, secure the authority to distribute assets, and investigate and pursue fraudulent transfer and illegal distribution claims against third parties.
