Sendero Health Plans Brings Litigation Against Federal Government for ACA Risk Corridor Payment

Our firm represented Sendero Health Plans in their lawsuit against the federal government for unpaid risk-corridor payments. The Patient Protection and Affordable Care Act (ACA) required an establishment of unpredictable new insurance markets. The ACA offered a "risk-corridor program" that promised to compensate insurers for much of their losses as they transitioned into these markets. 


The matter was stayed pending a Supreme Court opinion in Land of Lincoln and Moda, which issued on April 27, 2020. The Supreme Court held that the government was obligated to make full risk corridors payments.
