Overview

Nick Franchetti is a trial attorney who focuses his practice on defending employers ranging from small businesses to large corporations and public entities. Nick handles a range of litigation and has extensive experience in trade secret and noncompete enforcement, violations of the New Jersey Law Against Discrimination, minority shareholder oppression, civil rights cases, and consumer fraud act violations.

With a background in computer science, Nick also counsels companies on data privacy, cybersecurity, data-breach response and the use of artificial intelligence.

Employment Litigation

An effective lead counsel at oral argument, plenary hearings and other court appearances, Nick enjoys the challenge of a complex case. A fan of logic and reasoning, he addresses clients’ concerns, making sure they understand the legal concepts and how the law functions. Nick advises clients with unique circumstances and develops case strategies and novel arguments to achieve their objectives. Nick handles all aspects of litigation including drafting and arguing motions, taking and defending depositions, examining witnesses, trial preparation, opening and closing statements, and negotiating settlements.

Cybersecurity & AI

A Certified Information Privacy Professional (CIPP), Nick has advised numerous companies and public entities on cybersecurity and technology-related issues, including counseling on data-breach responses and notifications across the United States. He also advises organizations on data privacy and legal considerations in the use of artificial intelligence.

Preserving Attorney-Client Privilege & Other Protections

Nick has extensive knowledge regarding the attorney-client privilege and similar protections. He has given presentations and trainings for employees and counseled companies on the best ways to maintain these protections during communications with outside and in-house counsel, other employees, and third-party consultants.

  • Four-year defense of an ADA and NJLAD failure-to-accommodate matter, including coordinating discovery efforts, defending multiple depositions, taking plaintiff’s final deposition, and drafting and successfully arguing the summary judgment motion.

  • Spearheaded data-breach notifications to thousands of affected individuals and companies across 20+ states with varying regulations for data breach compliance.

  • In a minority shareholder oppression action, analyzed corporate finances and leveraged accounting inconsistencies to obtain settlement.
