In “Finding Freedom? Noncompete Agreements Facing Stiff Challenges on State, Federal Level,” Indiana Lawyer turned to labor and employment partner David Given for his commentary after a bill that would eliminate non-compete agreements for physicians passed in the Indiana Senate.
Given commented that certain businesses would be disappointed if there was a total ban on non-compete agreements, adding that companies use those agreements to protect confidentiality, trade secrets and proprietary information.
“From a business perspective, there’s a lot of storm clouds swirling, but it’s hard to predict what the outcome will be, if any,” he explained.
Given added that clients often bring up non-compete agreements, specifically in terms of employee-employer contracts and sales of businesses, noting that it’s an area of employment law where there are frequent disputes.
