Remote Work and Restrictive Covenant Agreements

Labor and employment partner Greg Abrams and associates Sylvia Bokyung St. Clair and Taylor Brook coauthored an article for Reuters addressing the increase in non-competition and nondisclosure legislation, as well as tips for navigating this landscape.

The authors outline how multiple states have imposed more onerous restrictions, if not outright bans, on employers’ use of restrictive covenant agreements. They also explain that these new laws have created additional obstacles for businesses managing remote workforces and share four questions employers should consider.

In conclusion, the authors state that employers should be mindful and proactive about addressing how their employment agreements may need to continue to accommodate work-from-home settings.
