Los Angeles partner Fred Reish and Florham Park counsel Joan Neri collaborated on “DOL Gives Private-Equity Guidance,” which appeared in the July/August 2020 edition of PLANADVISER. The authors provide some key takeaways from the DOL’s recent information letter providing guidance on the evaluation process for determining whether an investment fund having a private equity component is a prudent plan investment option under ERISA fiduciary standards. “In advising such clients,” the authors caution that “advisers should also consider that the scope of the DOL guidance is limited. For instance, it does not address the selection of private equity investments offered directly as investment options to participants.”
