Client Successfully Closes Year-Long Immigration-Related Wage & Hour Investigation

A manufacturer successfully resolved a lengthy wage and hour investigation, with counsel from our firm.
 
In October 2015, the U.S. Department of Labor’s (DOL) Wage and Hour Division served a firm client with notice that it was conducting an investigation into the company’s compliance with the federal Labor Condition Application (LCA) and wage and hour laws in connection with the company’s employment of foreign workers on H-1B work visas. The DOL investigation lasted over a year, involving a Wage and Hour onsite visit and production of extensive documents relating to the foreign workers’ pay, benefits and job duties, and to prove the company’s compliance with joint DOL and immigration law requirements for H-1B employers.
 
In January 2017, the federal Wage and Hour Division issued a determination confirming that no violations were found. The successful resolution of this case demonstrates how our firm can provide clients with the highest levels of expertise in both business-related immigration and wage and hour law to address complex federal compliance matters.
