Honeywell and a newly hired employee defeated Emerson Electric Company's motion for a preliminary injunction to enforce a non-compete agreement and prevent the employee from working for Honeywell. Our firm represented third-party Honeywell and the Honeywell newly hired employee.
Emerson had previously sued three different international executives for breach of essentially the same agreement and had won all three prior cases. This time the result was different. The court denied Emerson’s motion for a preliminary injunction and largely adopted Honeywell’s proposed order regarding that motion.
