Overview

Kevin DeMaio litigates high-stakes commercial disputes at both the trial and appellate levels, with a focus on trade secret litigation and environmental litigation. He is experienced with pre-litigation counseling, internal investigations, arbitration, discovery, dispositive motions, trials, post-trial proceedings, and appeals. At the trial level, Kevin has first-chaired in federal court, presented successful oral arguments, and helped secure important victories at trial.

He regularly counsels clients on the legal disputes affecting their business and is an active member of the firm's trade secrets team and environmental litigation team.

Trade Secret Litigation & Counseling

Kevin helps companies handle trade secret matters at whatever phase they arise. His experience includes investigating alleged trade secret theft in advance of litigation, initiating trade secret actions, and defending against claims of trade secret misappropriation. Kevin also counsels companies on protecting their trade secrets and has experience advising clients on their trade secret protection policies and procedures.

Environmental Litigation

Kevin defends clients in a variety of environmental litigation matters, including large, multiparty cleanup cases, and contractual or tort disputes over environmental liabilities. He defends clients from suits brought under federal and state environmental statutes, including the Clean Water Act, the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), New Jersey's Air Pollution Control Act, New Jersey's Noise Control Act, and New Jersey's Environmental Justice Law.

Prior Experience

Upon graduating from law school and prior to joining the firm, Kevin served as a law clerk to the Honorable Anne E. Thompson of the US District Court for the District of New Jersey. While in law school, Kevin served as a judicial intern for the Honorable Cathy L. Waldor, also of the US District Court for the District of New Jersey.

While in college, Kevin played football for the Princeton University Tigers.
