Construction Dispute Resolution

Ethan represents clients in disputes before state and federal courts, as well as in arbitration and mediation proceedings. He works closely with clients from a dispute's earliest stages — evaluating claims, developing strategy, and pursuing cost-effective resolutions. In complex construction and commercial litigation, Ethan oversees budgets and e-discovery; drafts motions and briefs; and first- and second-chairs depositions, mediations, and hearings. 

He collaborates with engineers, architects, and construction professionals to investigate defects, assess project delays, and interpret technical data for case strategy development. Ethan coordinates with clients, experts, and litigation teams to efficiently advance matters.

Representative Dispute Resolution Experience

• Represented a subcontractor in a $25 million construction litigation concerning the Charlotte, North Carolina, airport, including oversight of e-discovery and document analysis; preparation of witnesses for depositions; taking a 30(b)(6) deposition; and partnering with scheduling, damages, and geotechnical experts to prepare expert reports.
• Represented a general contractor in a $90 million, three-week construction arbitration concerning a solar farm project, including preparation of witnesses and experts for arbitration testimony, primary responsibility for coordinating scheduling analysis with testifying experts, and drafting of pre- and post-arbitration briefs.
• Represented a general contractor in a $20 million, multiparty construction defect litigation regarding an amusement park development in New York. Oversaw e-discovery, prepared witnesses, and drafted motion papers.
• Represented a large telecommunications owner in a $50 million construction arbitration concerning right-of-way licenses for fiber optic cables along a railroad’s property. Participated in e-discovery, coordinated damages experts, and drafted motion papers.

Construction Transactions

Ethan advises clients on the contracts and risk management strategies that support successful construction projects. He drafts and negotiates agreements tailored to clients' business objectives — from customized project-specific contracts to industry-standard American Institute of Architects (AIA) and ConsensusDocs forms. He is experienced in data center, health care, manufacturing, and commercial office projects. 

Throughout the project lifecycle, Ethan helps navigate contract administration issues, including change orders, contract variations, and insurance requirements. With attention to detail and an approachable communication style, clients benefit from his strong analytical and drafting skills, which help develop favorable solutions and outcomes.

Personal Interests

In his free time, Ethan competes in powerlifting, keeps up with his hometown Kansas City Chiefs, and explores the Colorado mountains.
