Overview

Brittany Kaplan supports clients in the development and protection of their intellectual property portfolios with particular focus on trademark clearance, prosecution, protection, enforcement and portfolio management. Providing individualized strategic guidance, Brittany helps clients navigate the lifecycle of trademarks from selection and clearance to filing and registration, and finally maintenance and enforcement. With experience ranging from startups to global corporations in an array of industries, Brittany assists companies in building and enforcing their brands worldwide.

Beyond domestic and international trademark prosecution, Brittany has experience handling trademark disputes at the Trademark Trial and Appeal Board. She is equipped to advance clients’ interest through dispute management strategies including negotiating assignment, coexistence, consent, license and settlement agreements related to intellectual property. She also counsels clients on intellectual property matters related to complex commercial transactions. Brittany counsels clients who face cybersquatting and online infringement matters including domain name disputes pursuant to the Uniform Domain-Name Dispute-Resolution Policy, and website and social media takedowns involving the Digital Millennium Copyright Act.

On behalf of clients, Brittany assists with marketing and advertising matters related to consumer promotions including sweepstakes, contests and influencer campaigns.

During law school, Brittany served as the Managing Editor of the Journal of Intellectual Property and was a member of the Saul Lefkowitz Moot Court Competition’s 2018 National Championship team.

Prior to becoming an attorney, Brittany worked as a magazine editor for almost a decade.
