Overview

Olivia Clavio provides experienced counsel to clients as they acquire, protect and enforce their intellectual property rights. Olivia’s extensive knowledge and media insight benefits clients navigating a variety of advertising, promotional and marketing matters in traditional and digital commerce. Her experience includes advertising claim development, substantiation, and defense of claims; drafting contest and sweepstakes rules; social media interactive campaigns; user-generated content review; co-promotional agreements and influencer agreements. Olivia represents companies before agencies including the Federal Trade Commission (FTC) and National Advertising Division of the Better Business Bureaus (NAD). She assists with disputes at all stages, including pre­litigation dispute resolution, intellectual property enforcement and protection, discovery, dispositive motions and triaI. She also provides guidance regarding right of publicity, trade secret and unfair competition issues.

Olivia supports clients through the entire branding process, including searching, registering and maintaining domestic and globaI trademark portfolios, developing and implementing domestic and international brand strategies, enforcing trademark and brand rights, packaging and label review, trade dress registration and enforcement, trademark licensing, negotiating intellectual property agreements, and due diligence in M&A and other business transactions.

Prior Experience

Before joining Faegre Drinker, Olivia worked at a boutique IP firm where she co-founded a beauty and wellness practice and served as the firm’s counseling practice group leader.

She spent more than a decade in the IP practice of another major law firm, advising clients from Silicon Valley startups to Fortune 500 companies on trademark, advertising, media, sponsorship, licensing, trade name, entertainment, copyright, e­ commerce and internet law. Prior to her legal career, Olivia worked extensively in media and advertising. 

Personal Interests

When she’s not in the office, you’ll find Olivia spending time with her two sons and an endless roster of foster kittens.
