Jessica Abrahams Discusses Significant Government Contracting Policies of 2026 With Law360

Government contracts partner Jessica Abrahams spoke with Law360 about significant government contracting policies from the first half of 2026.

In the article, Law360 highlights the Office of Management and Budget’s (OMB) proposed rule to amend the agency's guidance for federal financial assistance, which includes a provision mandating that senior appointees review awards before they are made to determine whether they're consistent with agency priorities and the national interest.

Abrahams noted that the proposed rule, in conjunction with ongoing litigation over grant termination challenges under the Tucker Act, could significantly reshape the federal grant program.

"Among other things, it dramatically limits any rights or remedies that grantees have, especially if, per this new proposed rule, OMB is able to move forward and basically not only allow all grants to be vetted by political appointees, but secondarily basically include this sort of termination for convenience clause in grants, so that they can be terminated for whatever reason at any time with limited rights and limited recourse for the grantees and the grantee entities," Abrahams said.
