Legislature’s Overhaul Expands Housing Supply, Reins in HOAs

Government and regulatory affairs partner Chip Garver and counsel Lacey Berkshire co-authored an article for The Indiana Lawyer that provides an overview of five key House Enrolled Acts from Indiana’s 2026 legislative session.

Garver and Berkshire note that the reforms to local zoning authority, rental restrictions, Homeowners Association (HOA) fee and fine procedures, and homeowner rights indicate that the General Assembly views housing affordability and access as urgent policy priorities.

“Taken together, these five acts represent a deliberate, thoughtful effort to expand housing supply, rein in HOA overreach, and protect homeowner rights, while leaving some battles, particularly on local zoning preemption, to future sessions,” the authors conclude.
