Ryan Funk Speaks With Law360 About NLRB Dismissals Surge

Labor and employment partner Ryan Funk spoke with Law360 Employment Authority about the increased rate at which the National Labor Relations Board (NLRB) has dismissed unfair labor practice charges during the second Trump administration as leaders seek to clear through a hefty backlog of cases.

“NLRB prosecutors have been more willing to settle cases lately than they were under former President Joe Biden, whose general counsel Jennifer Abruzzo demanded stiff terms in deals. Coupled with the rescission of several of Abruzzo's initiatives to broaden the National Labor Relations Act's protections, this change appears to be culling litigation,” Funk said.

“The regional staff are being freed from having to invest so much time in those initiatives … and being empowered and encouraged to do the kinds of things that provide a lot of resolution to people who have business in front of the agency,” Funk added.
