Long Term Care Insurance: Intended for Care Alone?

Insurance partner Sandy Jones drafted an article for The Legal Intelligencer titled, “Long Term Care Insurance: Intended for Care Alone?”.

The article discusses the transition and need for long-term care insurance. In May 2025, the U.S. Court of Appeals for the Eleventh Circuit issued its opinion on appeal from the U.S. District Court for the Middle District of Florida in a case called Parker. Like the fact-pattern above, the Parkers—who had purchased long-term care insurance policies in 1991—now in their mid-80s, moved into an assisted living facility.

For insurers, Parker helps to solidify a somewhat amorphous industry problem as to what an insurance company is to do when faced with “old policy language,” but a “new” or not specifically named-in-the-policy facility type.
