What New Colorado Noncompete Law Means for Employers

Deputy general counsel and labor and employment partner Mary Will and counsel Jill Zender coauthored an article for Law360 on employer considerations in light of Colorado’s newly enacted law that limits the applicability of employee noncompete agreements.

Will and Zender examine key provisions of the noncompete statute, review agreements that are still permissible under Colorado law and outline steps employers should take now to comply with the new law.

In conclusion, the authors recommend reviewing employment, noncompete and confidentiality agreements — particularly those applicable to Colorado employees — and potentially updating or removing certain provisions.
