A number of law suits have emerged attempting to thwart the implementation of the U.S. Department of Labor’s (DOL) “persuader” rule, which the agency finalized and released at the end of March. In an article published in Law360, Faegre Baker Daniels partner Jennifer Bickley Hull and associate Ryan Funk explained the legal challenges to the new rule, which “greatly expands” the information companies will have to disclose to the federal government regarding meetings with their labor relations consultants—including attorneys.
“The plaintiffs in these lawsuits ask the courts to temporarily enjoin the persuader rule pending the courts’ rulings on the lawsuits, declare the rule to be invalid, vacate the rule and permanently enjoin the DOL for implementing the new rule,” the article said.
