In March 2014, the governor of Indiana signed a law making military service a protected class in the state of Indiana. The law, which passed overwhelmingly in the Indiana General Assembly, makes it illegal to deny employment based on veteran status, or to refuse to hire an applicant who is an active member of the Indiana National Guard.
Stuart Buttrick, leader of the labor management relations team at Faegre Baker Daniels, told XpertHR that since many federal protections already exist for service members, employers should need to make only minimal changes. "The statute will likely not require significant human resources changes by Indiana employers as the federal Uniformed Services Employment and Reemployment Rights Act, which applies to all civilian employers, already prohibits employers from denying employment on the basis of a person's past or present membership in the uniformed services," Buttrick said.
