Finance and restructuring partner Richard Bernard served as a panelist for the American Bar Association Business Law Section program “Liquidity Challenges in Chapter 11” at the National Conference of Bankruptcy Judges’ 2026 Annual Conference. Finance and restructuring partner Brett Fallon served as chair of the program.
The program examined liquidity as a central operational challenge in Chapter 11 cases, covering cash collateral and debtor-in-possession financing, administrative solvency, budgeting and cash management, critical-vendor and other vendor-payment strategies, and more.
In the session, Bernard shared strategic and tactical approaches to navigating administratively thin cases that are approaching, or have already reached, administrative insolvency to achieve the best possible outcomes for unsecured creditors.
