Overview

Faegre Drinker intellectual property counsel Christina Huang presented on “Artificial Intelligence in Healthcare: IP Risks and Rewards” — which included contributions from Andrej Barbic of Bristol-Myers Squibb Company, Christopher George of Hanley, Flight & Zimmerman and Christopher Karlen of Medtronic — during the Intellectual Property Owners Association’s 2021 Annual Meeting on September 20, 2021. The session explored strategies for protection of artificial intelligence/machine learning (AI/ML)-based Software as a Medical Device (SaMD) according to United States patent practice, as well as potential conflicts between Food and Drug Administration and U.S. Patent and Trademark Office requirements. Attendees also learned about data protection and other legal risks that arise out of deploying predictive AI models in SaMD products, as well as techniques for safeguarding against AI privacy attacks and sensitive information leakage in AI deployments. The sessional was also presented virtually on September 28, 2021.
