Advanced Patent Law & Litigation: Developments in Means-Plus-Function Claims

Overview

Ever since the Federal Circuit’s en banc ruling in Williamson v Citrix, means-plus-function claims have received significant attention. In this seminar, Faegre Drinker Partner David Gross and his fellow presenters explored the latest developments and trends relating to means-plus-function claims, including when claims are invalid as indefinite for failure to adequately support the means-plus-function limitation, how to navigate IPRs involving means-plus-function claims, and when the presumption in favor of or against claims being means-plus-function is invoked or overcome. We will look at the most recent Federal Circuit cases in this area, as well as important rulings from the PTAB. Finally, we will briefly touch on recent legislative proposals involving means-plus-function claiming and developing areas in this area of the law to keep in mind for your cases.
