Partner Tracey Salmon-Smith is speaking on “Restrictive Covenants: A Look Behind and Ahead” at the Labor and Employment Law Section of the New York State Bar Association’s annual meeting on Friday, January 22, 2021. Tracey’s program is eligible for one CLE credit in the areas of professional practice.

In recent years the use of restrictive covenants, and particularly noncompetition agreements, has become much more widespread. Even employees in some service and retail positions, who have no special skills and do not have access to confidential information, are being required to sign them as a condition of employment. Tracey is joining a panel examining the topical and controversial issues surrounding the use of noncompetes and other restrictive covenants, including the validity of enforcing them against employees terminated without cause and differences in how courts enforce noncompetes as opposed to nonsolicitation provisions.
