Session Two (Tuesday, October 6, 2020) – ONC’s Information Blocking Rule: Overview, Exceptions, and Enforcement

While the entire Heath Care Industry has been focused on meeting the challenges of the COVID-19 pandemic, the Office National Coordinator for Health Information Technology issued the final Information Blocking Rule that is widely seen as a “game changer” for the sharing of electronic health information (“EHI”) that will significantly impact health care providers, health information networks (“HINs”) and anyone that develops or simply offers Certified Health IT. Because of the way the rule is structured, organizations could find themselves subject to the new regulations in unexpected ways (e.g., a provider could be subject to the rules and penalties that apply to an HIN or even a Health IT Developer). The cost of non-compliance is high, including up to $1M civil monetary penalties for each violation and yet to be determined “appropriate disincentives.” All organizations that touch EHI need to be aware of the new obligations created by these regulations so that they assess the practical business implications and take the appropriate steps to address compliance.

Session Three (Thursday, October 8, 2020) – ONC Information Blocking Rule: A Panel Discussion of the Practical Applications of the Rule

As a follow-up to our first webinar on the ONC’s Information Blocking Rule, this webinar will focus on the practical applications of the Information Blocking Rule, and the challenges it presents to providers. Specifically, we will discuss the ambiguities in the Rule, the uncertainties created where the Rule and HIPAA are not completely in sync, and potential unintended consequences of the Rule.

Session Four (Tuesday, October 13, 2020) – Rural Hospitals and Health Systems: Key Trends, Common Models and Insight for Affiliations and Physician Transactions

In the wake of financial pressures caused by the public health emergency, many rural hospitals are more interested in pursuing strategic partnerships with larger systems. Financial pressures on physician groups have also caused some physicians to be more open about forming a closer relationship with hospitals. In this session, we will cover: Common models for affiliation, Key models for achieving a closer relationship with a physician group, and Key takeaways from a regional survey on rural hospital physician compensation conducted by Faegre Drinker.

Session Five (Thursday, October 22, 2020) – Bankruptcy 101

Long considered a taboo subject, bankruptcy is becoming a reality for many, regardless of industry sector. What does it mean if a vendor or customer files for bankruptcy, and if you are the party in distress, how should you manage your own difficult position? While there is no one way to address these issues, it is important to understand the issues presented by a bankruptcy filing in the context of your client’s business relationships. Topics will include the automatic stay, different chapters of the Code, assumption and rejection of leases and contracts and types of claims. We will also discuss the roles of various parties in a bankruptcy case and certain bankruptcy terminology (so you can sound like an expert to your clients). Our presenters will also discuss strategies and best practices for how to handle these issues and mitigate risk.

Session Six (Thursday, October 29, 2020) – Guaranteed Realized Savings

Chicago partner and President of Innovative Health Strategies™, Neil S. Olderman, will discuss how IHS’s hospital-clients are generating savings by evaluating purchased services and other strategic vendor partnerships. Brett W. Warner, Assistant Vice President of IHS, will highlight Clinical Engineering, which is a complex and often-overlooked category that can deliver significant cost-savings and service-level improvements. Atlanta-based counsel and Vice President of IHS, Mark W. Phillips, will share a recent savings success story for the high-spend, high-impact categories of Food & Nutrition Services and Environmental Services and the financial models used to ensure savings hit the hospital’s bottom line.

Session Seven (Thursday, November 5, 2020) – Physician Contracting under the New Stark Rules

Our attorneys will discuss the scope of HHS’s fraud, waste, and abuse rules. The discussion will look at the new Stark rules proposed by HHS and their implications on physician contracting. We will also discuss the temporary rules issued during the coronavirus pandemic, including how they have been leveraged in contracting and the likelihood of their extension beyond the end of 2020.

Session Eight (Tuesday, November 10, 2020) – Policy Update After the Election

Ilisa Halpern Paul, President, and Jodie Curtis, Executive Vice President – the leaders of the District Policy Group at Faegre Drinker – will present an overview of the results of the 2020 election and discuss how the outcome of the election will impact health policy for the balance of 2020 and the Congressional and Executive Branch agendas for 2021.
