Faegre Drinker Launches Artificial Intelligence and Algorithmic Decision-Making Team

Faegre Drinker announced today that the firm has formalized the launch of an interdisciplinary artificial intelligence and algorithmic decision-making (AI-X) team. The AI-X team will advise clients across industries on regulations and risk management associated with AI technologies.

The AI-X team combines the regulatory and litigation experience of attorneys who have advised and represented clients on these issues for years with the data scientists at Tritura, Faegre Drinker’s AI subsidiary, to create a unique and powerful service for clients. With this interdisciplinary approach, the team will help clients leverage the value of AI and algorithms in a safe, legal and ethical manner, understand the risks related to automated decision-making, respond to emerging laws and regulations, keep up with industry best practices, and protect their interests when litigation arises. The team is also positioned to help clients as they develop AI-driven solutions and products or seek to leverage, license and protect proprietary data and models. And as clients face growing regulatory concerns about the use of algorithms, the team’s data scientists can advise on the innerworkings of these technologies, including testing client algorithms for unintended bias.

"Innovation is part of Faegre Drinker's DNA and how we approach client service," Faegre Drinker co-chairs Tom Froehle and Andrew Kassner said in a joint statement. "The launch of the AI-X team is one of the firm's latest efforts to meet the needs of our clients working with complex and important technologies during uncertain regulatory environments."

“Many of our clients are using or considering using AI and algorithms to assist them in making business decisions, but the lack of clear regulatory guidance and standards puts their corporate and legal stakeholders at increased risk,” said co-leaders of the firm’s AI-X team Bennett Borden and Scott Kosnoff. “Our goal is to continue to help clients find value in these cutting-edge tools while also delivering peace of mind on issues relating to this rapidly evolving legal and regulatory landscape. This team includes many longtime AI advisers and data scientists, and we are excited to grow our partnership with clients to help them lead the way on this innovation.”

The AI-X team offers focused support in the areas of insurance, labor and employment, health and life sciences, antitrust, autonomous vehicles, and privacy and cybersecurity.

On April 27, 2022, the team hosted a webinar titled “AI, Algorithms & Unintended Bias: Understanding and Responding to Emerging Regulations on Automated Decision-Making.” A recording of the webinar is available via the link.
