Cheryl Orr Quoted by SHRM on Federal and State Record-keeping Requirements

Labor & Employment partner Cheryl Orr was quoted in an article for SHRM titled “How to Comply with Payroll Record-Keeping Requirements.” The article discusses federal and state record-keeping requirements for wage-and-hour compliance.

Industry professionals stress that employers comply with both the federal Fair Labor Standards Act (FLSA) and state-specific requirements. Cheryl noted, “[g]enerally, the requirements that are more restrictive—i.e., more employee-friendly—are applied… Multistate or national employers should work with their counsel for guidance on what they need to store, for how long and where."

Cheryl recommended that employers should have secure processes for determining who has access to the records and how they are retained, adding that “[i]t is also important that the utmost is done to protect the confidentiality of employee records and the privacy of information contained in them."
