Lynne Anderson Quoted in Business Insurance on DOL’s Withdrawal of Joint Employment Guidance

Florham Park partner Lynne Anderson was quoted in a Business Insurance article titled, “Employers welcome Labor’s move on joint employment, independent contractors.” The Department of Labor recently withdrew the Obama administration’s joint employment and independent contractor guidance that expanded the definition of an employee.

While employers may be relieved, many in the industry warn that the department will still continue to enforce all laws within their jurisdiction. “Employers need to be mindful that these relationships are still subject to current federal case law and regulations. Those have not gone away,” said Lynne. She also noted that many employers are subject to their states’ case law and regulations, which “essentially do much the same as these administrative interpretations.”
