Lynne Anderson Quoted in Newsday Discussing New EEOC Reporting Requirements

Florham Park partner Lynne Anderson was quoted in a Newsday article titled, “New rules require large firms to report pay data by gender, race.” In an effort to combat pay discrimination, the Equal Employment Opportunity Commission (EEOC) will require businesses with 100 or more employees to report summary pay data and hours worked, in addition to information already reported that includes the gender, race and ethnicity of employees in various job categories.

The new requirement is set to go into effect in March 2018, though Trump’s acting EEOC Chair, Victoria Lipnic, has stated that a petition for reconsideration of the rule’s costs and benefits has been filled with the Office of Management and Budget. Lynne noted that there may be a modification to the reporting requirements, but that a repeal would be less likely since Lipnic has stated she considers equal-pay issues a priority.

Lynne also noted a possible change in the EEOC’s structure, stating, “the current structure of the five-member EEOC could change because there will be two vacancies come July, at which point Trump could appoint two Republican nominees,” and noting a repeal of the new EEO-1 reporting obligations would require a majority vote.
