An agricultural input supplier received summary judgment in its favor in a case brought by an ex-employee who alleged discrimination based on a perceived impairment. Our firm represented the agricultural input supplier in the matter.
The agricultural input supplier had acquired an anhydrous ammonia and chemical fertilizer operation in western Iowa where the plaintiff, who had reduced vision due to a hereditary eye disease, was employed. Co-workers raised concerns that he was missing important safety cues and could endanger himself and others. The agricultural input supplier terminated his employment and argued in litigation that because the employee lacked night driving privileges, he was not a qualified person with a disability and therefore could not maintain his disability discrimination claims.
The case was removed to federal court in February of 2020, where the Chief Judge of the Northern District of Iowa granted summary judgment to the agricultural input supplier.
