Overview
Melissa Marks counsels clients in litigation, construction defect matters, contract interpretation and risk analysis. Leveraging a deep knowledge of construction law, she provides clients with strategic guidance aimed at favorable resolutions for matters involving residential, commercial and mixed-use properties — from dispute resolution to transactional review.
Construction & Real Estate Disputes
She has litigated complex construction defect, breach of contract, payment, and property damage cases from commencement of claim through trial or settlement, including representing clients at hundreds of depositions, mediations, arbitrations, jury trials, and all federal and state court appearances. Melissa conducts risk evaluation and advises on legal strategy based on a company’s financial and legal exposure. She also provides clients with practical solutions and training materials to better protect their organizations from potential litigation.
Construction & Real Estate Transactions
Melissa drafts, negotiates, revises, and interprets contract agreements, releases of liability, and nondisclosure agreements, with a focus on general contractor, design/build, subcontractor scope-of-work agreements, and cost-plus and fixed-fee contracts for large construction projects. She represents a broad array of clients, including owners, nonprofit organizations, general contractors and design professionals. Melissa evaluates and revises contracts to ensure compliance with state and federal statutory requirements. Her guidance helps clients feel confident that their agreements are enforceable and reflect the current laws and regulations.
Personal Interests
In her free time, Melissa enjoys fly fishing, backpacking and disc golf. After spending many years on the East Coast, Melissa moved to Colorado in 2012 to enjoy bigger mountains and better snow. She is also a licensed skydiver, with hundreds of solo skydives across the country.
