Bloomberg turned to customs and international trade partner Mollie Sitkowski for insight for their article, “US to Appeal Judge’s Order for Broad Refund of Trump Tariffs,” that examines the legal uncertainty surrounding refunds for tariffs collected under President Trump’s use of emergency powers.
The article states that the Justice Department has appealed a court order that would require U.S. Customs and Border Protection (CBP) to issue broad refunds to all importers affected by the now-invalidated tariffs, injecting further ambiguity into an already complex claims process. Sitkowski cautioned importers, sharing that “we continue to recommend importers wait and see before making any filings at the CIT as the statute of limitations will not run until February 2027.”
