Mollie Sitkowski Discusses Potential Refunds for Tariffs With Bloomberg

Customs and international trade partner Mollie Sitkowski spoke with Bloomberg about how businesses affected by tariffs may seek refunds for charges they paid following the Supreme Court’s decision to strike down President Donald Trump’s tariff scheme. 

While one potential option for business to secure their refund is to initiate a lawsuit, Sitkowski advised holding off for now, noting that litigation can be time consuming and expensive – potentially hundreds of thousands of dollars. 

However, while simpler, unliquidated refund payments may be issued within mere months, more complicated entries crossing multiple tariff-affected jurisdictions could take longer to be issued – at which point litigation may be on the table, Sitkwoski said. 

“If this refund process takes longer than through the end of this year, then we would actually start recommending people file lawsuits,” she noted.
