Lou Perry Speaks With Indiana Lawyer About James Dean Trademark Violations Lawsuit

Intellectual property partner Lou Perry discussed with Indiana Lawyer a federal lawsuit claiming that numerous foreign companies are selling counterfeit James Dean products online in the United States. According to the suit, these actions harm sales for James Dean Inc., the Fairmont, Indiana-based trademark holder, create customer confusion, and risk damaging the brand’s reputation.

James Dean Inc. launched a “Schedule A” case in the U.S. District Court for the Western District of Texas. “The scale and speed of counterfeiting is increasing,” Perry said. He noted that Schedule A cases, which allow revenue from potentially improper sales to be frozen while the case plays out, are a powerful tool to deal with it.

“It really reflects how trademark enforcement is evolving from kind of storefront policing to coordinated digital platform disruption,” he added.
