Avoiding Litigation: Dialogue and Social Capital Can Often Resolve Disputes

In an article for Franchising.com, corporate partner Brian Schnell shared that certain franchise disputes can only be resolved through litigation.

Schnell discussed the importance of dialogue. He noted that “dialogue embraces the reality that franchisor and franchisee interests, roles, and responsibilities are similar in some respects and quite different in others.”

In addition, Schnell highlighted the cause and effect of how any potential change made by franchisors affects franchisees. He said, “Walking in someone else’s footsteps and seeing things through their eyes often leads to creative solutions, which will lead to better outcomes and less litigation.”
