In “DOJ Crackdown Prompts Compliance Scramble on WhatsApp, Signal,” Bloomberg Law spoke to white collar defense and investigations partner Henry Van Dyck, who is also a former federal prosecutor, about a Department of Justice policy that directed prosecutors to levy steeper penalties against firms under investigation that are unable to preserve workers’ business-related messages.
“There are concerns over how to strike the right balance between employees having a sense of personal privacy at work and not feeling like their employer is Big Brother versus a company’s interest in complying with the new guidance,” said Van Dyck. “That’s a difficult balance to strike for many companies.”
