Protecting Trade Secrets in the District of New Jersey

Product liability and mass torts attorneys Michael Zogby, Kaitlyn Stone and Alison Thompson coauthored an article for the New Jersey Law Journal. The authors address protecting trade secrets in the District of New Jersey and the Third Circuit, focusing on recent trade secret decisions from those courts, and analyze the overlaps often seen between these federal law and state law claims.

Zogby, Stone and Thompson provide insight on the Defend Trade Secrets Act (DTSA) and the New Jersey Trade Secrets Act, and on pleading a DTSA claim in the Third Circuit.

The article also outlines two practical considerations that companies filing trade secret misappropriation claims and defendants who have such claims filed against them should carefully analyze early – 1) jurisdiction and venue and 2) litigation disclosure.
