Health Care Is in DOJ’s Criminal Antitrust Crosshairs

In a coauthored article for Law360, antitrust partner Dylan Carson and white collar defense and investigations partner Tony Pozos discuss the recent increase of criminal antitrust enforcement in the health care sector by the U.S. Department of Justice (DOJ) Antitrust Division.

The authors review the origins of the DOJ’s emphasis on health care and life sciences antitrust enforcement, and the expansion of charges by the Antitrust Division that followed.

Carson and Pozos also address the trend of labor market prosecutions that began heating up in late 2020, as well as common pitfalls to avoid and antitrust compliance recommendations that health care industry participants should keep in mind.
