Protecting Trade Secrets: A New Jersey Overview

Product liability and mass torts attorneys Michael Zogby, Kaitlyn Stone and Alison Thompson coauthored an article for the New Jersey Law Journal that focuses on protecting trade secrets under New Jersey law. They provide an overview of the New Jersey Trade Secrets Act (NJTSA) and how the NJTSA has been interpreted by the courts.

The authors also highlight how the NJTSA provides real protections to companies’ trade secrets and protects companies facing a misappropriation of trade secrets, but that the best trade secrets protections are proactive and not reactive. They recommend that consulting with counsel regarding forward-thinking strategies for protecting intellectual property every step of the way is the strongest approach to trade secret protection under New Jersey law and beyond.

The article also outlines three steps to keep in mind to proactively protect trade secrets: keep your trade secrets a secret; document every step of the way; and understand their value.
