Political Speech Versus Title VII – Which Trumps Which?

In an article for Law 360, Faegre Baker Daniels partner Martha Lemert and associate Angela Johnson shared their thoughts on how the upcoming presidential election may result in companies implementing stricter policies regarding political speech in the workplace. Employers may need to take extra precaution and create a politically neutral environment to avoid unwanted complaints and charges.

“Political discussions can easily turn into heated, confrontational debates that quickly become personal,” the authors said. “Thus, most employers would be well-advised to take action during this election cycle, even if they had not previously considered this issue, and particularly, equip management who work directly with the workforce with the tools to disarm and redirect heated workplace discussion and conduct.”
