Reid Dodge Weighs Benefits, Drawbacks of Indiana's New Patent Infringement Law
Faegre Baker Daniels associate Reid Dodge spoke with The Indiana Lawyer about a recently passed Indiana law designed to discourage frivolous patent infringement lawsuits. Under the new statute, parties that file a patent infringement claim in bad faith can be ordered by the court to pay for the defendant's attorney fees and the costs of litigation.
“I think this law, however well-intentioned, could end up disproportionately hurting individuals and smaller companies seeking to enforce their patents,” Dodge said. “On the other hand, this law has the potential to provide the intended benefit of preventing bad actors from sending a multitude of letters to various companies in the hopes of extorting some sort of payout."
