Sarah Brew, in an interview with Food Chemical News, predicted trends that are likely to take hold in courts for food companies this year. In 2012, labeling suits were very common, with the result that "GMO" products can no longer be labeled "natural." Brew anticipates those claims will taper off as food companies re-label their products accordingly, but expects other common label descriptions will now be targeted. "Consequently, plaintiff lawyers will continue to get more creative, targeting other label favorites, such as ‘wholesome,' ‘homestyle,' ‘sustainable,' or ‘fresh,' Brew said. She also expects cases involving clarification of commercial free speech issues as well as new rapid diagnostic testing for foodborne illnesses to impact the food industry this year.
