European Union Working Party Issues Opinion Regarding Guidelines for Addressing Conflict Between EU Data Protection Regulations and U.S. Discovery Obligations

A long-awaited Opinion from the European Union’s Article 29 Data Protection Working Party provides recommendations and observations regarding several aspects of the interplay between U.S. discovery and EU data protection including preservation, legitimate grounds for processing personal data in litigation, transparency, and the rights of data subjects in litigation.
