Washington, D.C., partner and co-chair of the Antitrust Practice Howard Morse, and Philadelphia associate Rick Coe, authored “No Vacation for Antitrust Regulators: Competition Authorities Spend Their Summer Focusing on the Pharmaceutical Industry,” published in the October 2009 issue of the Antitrust Health Care Chronicle. The article highlights the recent focus by antitrust enforcers in the United States and Europe on competition in the pharmaceutical industry, discussing recent reports issued by the Federal Trade Commission and European Commission addressing authorized generics, settlement of patent litigation and follow-on biologic drugs. Howard and Rick explain that these reports are likely to influence legislation pending in Congress that would limit settlements of pharmaceutical patent litigation and establish an approval process for follow-on biologic drugs. The reports also signal continued intense scrutiny of the pharmaceutical industry.
