E-Verify Federal Contractor Rule Postponed Until February 20
A coalition led by the U.S. Chamber of Commerce filed a complaint December 23, 2008, in Federal District Court challenging the legality of an executive order and related regulations requiring federal contractors to use the E-Verify system to verify employment eligibility of new hires and current employees assigned to the contract. The parties have struck a deal that will delay implementation of the regulation until February 20. A Federal Register notice implementing this delay until February 20 was issued on January 14.
Plaintiffs are hopeful the delay will give the incoming administration an opportunity to re-evaluate the policy—especially in light of the current economic crisis.
