Session Three (Wednesday, June 16, 2021) – The Average Income LIHTC Minimum Set-Aside

In March 2018, the Consolidated Appropriations Act of 2018 created average income as a third possible minimum set-aside election for the low-income housing tax credit (LIHTC). Income averaging (IA) permits owner of eligible LIHTC projects to designate units at 20% to 80% of area median gross income and include all of the units in LIHTC, provided that the average of the imputed incomes does not exceed 60%. However, the statute was complex and recently proposed regulations made income averaging less workable. This 60-minute webinar will cover the basic IA rules, the impact of the proposed regulations and possible changes in the regulations.

How can the new 40%-plus increase in new markets tax credits (NMTC) allocation help real estate developments? How the pandemic has affected NMTC pricing? And what types of projects are NMTC allocatees looking for? This 60-minute webinar will answer these questions, and will also include discussion of federal regulations adopted in 2020 pertaining to historic tax credits, legislation intended to address the pandemic’s effect, and the current status of the Minnesota state historic tax credits.
