Overview

Washington, D.C. partner Dawn Williams presented a Strafford webinar titled “Defeating Class Certification by Attacking Plaintiffs’ Classwide Damages Models” on August 8, 2019.

Panelists discussed the Comcast Corp. v. Behrend decision in which the U.S. Supreme Court held that the damages model plaintiffs use must measure damages only connected to the plaintiffs’ theory of liability. Since this case, lower federal courts have increased scrutiny on these proposed classwide damages models. The speakers analyzed the Comcast decision as well as strategies for combating those models based on economic, statistical or methodological flaws.
