Philadelphia partner Tony Pozos will lead a Clear Law Institute webinar on “Potential Benefits, Pitfalls and Uncertainties of Corporate Self-Disclosures” on February 12, 2019.
Tony will discuss important considerations for evaluating if and when to make a voluntary self-disclosure to the U.S. Department of Justice (DOJ), as well as recent policy announcements from the DOJ encouraging companies to self-disclose potential criminal conduct. He will evaluate potential advantages of self-disclosures, including leniency and other incentives for cooperation and, conversely, significant risks of self-disclosure, including government scrutiny, cost and institutional burdens. The conversation will also touch on uncertainties companies may face, such as factual ambiguities, governmental reservations of discretion and exposure to potential judicial uncertainty.
