Recent Developments in TCPA Litigation

Overview

Chicago partner Justin Kay was part of a three-person panel assembled by the Judicial Practice Committee of the Federal Communications Bar Association to speak at a CLE program on February 6 titled, “Recent Developments in TCPA Litigation.”

The event covered developments in the D.C. Circuit regarding the appeal of the FCC’s July 2015 Declaratory Ruling & Order, as well as litigation trends in the district courts. Justin provided insights on TCPA litigation and developments in the district courts from the perspective of the defense bar, while the other two panelists provided insights from the perspective of the plaintiffs’ bar and in-house counsel. Justin’s remarks focused on recent rulings on whether a communication is an advertisement or constitutes telemarketing.
